A claim was filed by the Deputy prosecutor of Kyiv represented by the Ministry of Ecology and Natural Resources of Ukraine to the Kyiv City Council in the interest of the state concerning abolishment and revocation of the City Council decision to dispose of land plots of “AvtoNafta” for the construction and maintenance of the Fuel Filling Station. The dispute settlement was found that the Kyiv city council acted within the limit of authority and under the law so there are no grounds for recognition of the decision unlawful and its abolition.
On 20 January 2014 the Appeal Administrative Court of Kyiv adopted a decision rejecting appeals of the Ministry of Ecology and Natural Resources of Ukraine and third parties and upheld the decision of the Kyiv District Administrative Court on 25 September 2013.
