Transfer Pricing in the Focus of INTAX FORUM UKRAINE 2016

On September 12-13, 2016 an annual two-day international conference INTAX FORUM UKRAINE took place in Kyiv. Since 2011 the conference has been a platform for experience exchange between international experts in the field of taxation, finance and tax planning.

The first day of the forum addressed issues of international tax planning and corporate business structuring.

At the invitation of the organizers, Larysa  Vrublevska, Head of Transfer Pricing practice at the International LegalCenter EUCON joined the conference. As part of the panel discussion “Legislative initiatives in the field of transfer pricing and deoffshorization strategy in Ukraine” Larysa told about the main deoffshorization activities in the international community, stressing that such reforms are inevitable for Ukraine as well. The main directions to achieve the planned goalsare Ukraine’s accession to the multilateral agreement on the exchange of financial and tax information; reconsiderations of Ukraine’s bilateral agreements on avoidance of double taxation in accordance with the principles of the OECD; development of legislation on controlled foreign companies and improvement of transfer pricing regulations. Larysa Vrublevska alsoanalyzed the report by the State Fiscal Service of Ukraine regarding the monitoring in the area of ​​transfer pricing, noting that the activity of the supervisory authority is gaining momentum. And if in the first half of 2015 the State Fiscal Service of Ukraine limited itself only to document analysis, having sent 26 requests regarding its filing, in the first half of 2016 the State Fiscal Service of Ukraine conducted 13 inspections of controlled transactions, 485 taxpayers were inspected for the facts of failure to file the report and 31 taxpayer was penalized in the amount of UAH 10.7 mln.

The forum brought together over 350 delegates, a quarter of which included delegates from 20 countries, experts from Cyprus, Switzerland, Malta, Luxembourg, Canada, the Czech Republic, the Baltic States and others.
