On September 20, 2019, the National Forum “International Taxation: Business Transformation” was held in Kyiv, the speaker of which was Yaroslav Romanchuk, attorney-at-law, the managing partner of the EUCON Legal Group.
During the second session, dedicated to TP and BEPS as a tool of transparency, Yaroslav Romanchuk spoke about the risks involved in operations with low tax jurisdictions, noting that European jurisdictions, including Poland, could be an alternative to business structuring.
In addition, Yaroslav Romanchuk stressed that the choice of jurisdiction should analyze the jurisdiction in the “black”/“gray” lists of EU, effective rates of tax on passive and other income, the presence of TP and CEC rules, the existence of a convention on avoidance of double taxation others aspects. The expert emphasized that with the implementation of the BEPS plan, the offshore era came to an end, which meant dramatic changes in both national and international taxation. In his view, the BEPS plan will not lead to new taxes, but will allow for a unified control approach in the future.
During the event, experts in the field of tax, representatives of law and audit companies, representatives of the Ministry of Finance and the STS, deputies of the Verkhovna Rada of Ukraine, tax advisers and consultants discussed the implementation of business transparency standards in Ukraine, methods of strengthening control over international transactions, start-up dates, systems for automatic exchange of information, strengthening of control over TP in 2019-2020, methods of business protection and risk minimization in new conditions.
The forum „International Taxation: Business Transformation” was also attended by: Danylo Hetmantsev, Nina Yuzhanina, Tetiana Ostrykova – deputies of the Verkhovna Rada; Oksana Markarova – Minister of Finance of Ukraine; Serhiy Verlanov – Chairman of the State Tax Service of Ukraine and others.
